By accessing or using Lona Technologies (the “Platform”), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform. These Terms are governed by the laws of the Republic of the Philippines.
1. Parties and Service Scope
These Terms are a binding agreement between Lona Technologies (“Provider”) and the business customer using the Platform (“Client”), including the Client’s authorized users.
The Platform is provided as business software for managing loan operations, customer records, and internal workflows.
2. B2B Platform Nature
The Provider is a software company and is not a lender, financing company, broker, collection agency, or debt collector. The Provider does not issue loans, set lending terms, approve borrowers, or collect debts in its own name.
All lending decisions, borrower communications, and collection actions are made solely by the Client.
3. Client Compliance Responsibilities
The Client is solely responsible for compliance with all applicable Philippine laws and regulations governing its lending business, including where applicable:
- RA 9474 (Lending Company Regulation Act)
- RA 3765 (Truth in Lending Act)
- RA 7394 (Consumer Act of the Philippines)
- RA 11765 (Financial Products and Services Consumer Protection Act)
- Relevant rules and issuances of the SEC, BSP, and other regulators
The Client must ensure all loan disclosures, pricing, consents, notices, and collection practices are lawful and properly implemented.
4. Permitted Use
The Client may use the Platform only for lawful business purposes. The Client must not use the Platform to perform fraudulent activity, unauthorized data access, harassment, or any illegal collection behavior.
5. Account Security and Access
The Client is responsible for maintaining account credential security, controlling user permissions, and keeping account information accurate and up to date. Activities under Client accounts are deemed authorized by the Client.
6. Data Privacy (RA 10173)
The Provider processes personal data in accordance with RA 10173 (Data Privacy Act of 2012) and applicable NPC regulations. The Client represents that it has obtained all required consents and lawful bases for any personal data entered into the Platform.

7. Service Availability and Changes
The Provider may maintain, update, improve, or modify Platform features from time to time. Reasonable efforts are made to maintain service availability, but uninterrupted or error-free operation is not guaranteed.
8. Fees and Billing
Subscription fees, billing intervals, and payment terms are governed by the selected plan and checkout terms. Unless otherwise required by law, fees paid for completed billing periods are non-refundable.
9. Amendments
These Terms may be amended at any time. Continued use of the Platform after notice of amendments constitutes acceptance of the updated Terms.
10. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be submitted to the proper courts of the Philippines or resolved through the appropriate regulatory body (SEC, BSP, or DTI).
