Terms & Conditions

By accessing or using Lona (the “Platform”), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform. These Terms are governed by the laws of the Republic of the Philippines.

1. Parties

These Terms constitute a binding agreement between the registered lending company (the “Company”) and its authorised users (“Users”) and borrowers (“Borrowers”) who use this Platform.

2. Regulatory Compliance

The Company represents that it is duly registered with the Securities and Exchange Commission (SEC) under Republic Act No. 9474 (Lending Company Regulation Act of 2007) and holds a valid Certificate of Authority to operate as a lending company in the Philippines. Users and Borrowers are entitled to request proof of registration.

3. Loan Disclosures (RA 3765 — Truth in Lending Act)

In accordance with Republic Act No. 3765, all borrowers shall receive a full disclosure of:

  • The total amount financed
  • Finance charges (interest, penalties, and fees)
  • Annual Percentage Rate (APR)
  • Total repayment amount and schedule

Such disclosure shall be provided prior to the release of any loan proceeds.

4. Interest Rates and Charges

Interest rates and charges shall be clearly defined in the loan agreement signed by the Borrower. All rates comply with applicable Bangko Sentral ng Pilipinas (BSP) and SEC issuances. No undisclosed fees shall be imposed on Borrowers.

5. Data Privacy (RA 10173 — Data Privacy Act)

Personal data collected from Borrowers and Users shall be processed in compliance with Republic Act No. 10173 and its Implementing Rules and Regulations. Data collected includes, but is not limited to, name, address, income, employment details, and government-issued IDs. Data shall be used solely for loan evaluation, management, and regulatory reporting purposes.

Borrowers have the right to access, correct, and object to the processing of their personal data. Requests may be directed to the Data Protection Officer (DPO) of the Company.

6. Collection Practices (RA 11765 & SEC MC 18-2019)

The Company shall observe fair and ethical collection practices in accordance with Republic Act No. 11765 (Financial Products and Services Consumer Protection Act) and SEC Memorandum Circular No. 18, series of 2019. The Company shall not:

  • Harass, threaten, or use obscene language toward Borrowers
  • Contact persons other than the Borrower and authorised references without consent
  • Access the Borrower’s contacts, photos, or files on their mobile device
  • Threaten to publish or publicise non-payment

7. Consumer Rights (RA 7394)

Borrowers are recognised as consumers under Republic Act No. 7394 (Consumer Act of the Philippines) and have the right to fair contract terms, complete information, and access to redress mechanisms. Any complaint may be filed with the SEC, BSP Consumer Protection and Market Conduct Office, or the Department of Trade and Industry (DTI).

8. Platform Use

Users agree to use the Platform only for its intended purpose of loan management. Unauthorised access, data scraping, or manipulation of the Platform is strictly prohibited and may be prosecuted under the Cybercrime Prevention Act (RA 10175).

9. Amendments

These Terms may be amended at any time. Continued use of the Platform after notice of amendments constitutes acceptance of the updated Terms.

10. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be submitted to the proper courts of the Philippines or resolved through the appropriate regulatory body (SEC, BSP, or DTI).
